Who Is Eligible For DACA?
To be eligible, you must:
- Have arrived in the U.S. before your 16th birthday, but no later than June 15, 2007
- Have been under 31 years of age as of June 15, 2012, with no lawful status at that point
- Have continuously resided in the U.S. since then
You must also meet certain educational or military service requirements. Additionally, you must have a clean criminal record, and you must not be deemed a threat to national security or public safety.
Suspension Of The DACA Program
DACA eligibility is subject to the potential overturning of the July 16, 2021, ruling by a federal court that currently suspends the program. Prior to this date, the law provided deportation deferrals for specified periods.
